著作權與商業授權

本章節詳細說明透過我們基於人工智能（AI）技術的設計平台所生成的設計作品之著作權歸屬與商業使用權利。

1. 真人參與及著作權狀態

在 Designora | 曜象，我們交付給您的每一份設計作品均經過專業設計師的深度審核與微調。由於作品中包含顯著的真人創意投入、藝術指導、素材策劃與品質管控，因此根據英國著作權法，最終確認的設計作品被視為包含真人作者身份（Human Authorship）並受著作權法保護。

2. 授予您的授權（商業使用權）

在您完成全額付款並收到最終確認的設計作品後，您將獲得：

永久、不可撤銷、非獨佔、免版稅且全球適用的授權

您可以：

  • 使用、重製、修改、調整、翻譯及基於該設計作品創作衍生作品；
  • 展示、分發、公開演示及進行商業化開發利用；
  • 在任何媒體、管道及格式中使用該設計作品（包括印刷、數位媒體、社交平台貼文、包裝設計、廣告橫幅、官方網站及實體產品）。

此授權允許您將交付的設計自由用於您的業務運營、品牌推廣、產品銷售及日常行銷用途，無需支付任何額外費用或後續版稅。

3. 交付設計之所有權

您擁有我們交付給您供商業使用的具體最終設計作品。一旦訂單完成全額付款，我們不會對最終確認並交付的設計作品主張著作權所有權。

4. 我們保留的權利（作品集與展示）

Designora | 曜象保留在我們的設計作品集、官方網站、社交媒體帳號、客戶案例研究、行銷推廣材料及宣傳內容中，使用、展示及宣傳該設計作品（或相似版本）的權利。我們在展示作品時可能會標註您的品牌名稱。如果您希望保持匿名，請以書面形式通知我們，我們將在合理可行範圍內尊重該請求。

5. 對您使用之限制

您不得：

  • 轉售、重新分發、轉授權原始設計檔案，或將設計作為庫存資產、設計範本或設計資源在第三方平台（例如 Shutterstock、Creative Market、Etsy 或類似交易市場）上架銷售；
  • 將此設計作品用於訓練 AI 模型，或將其納入用於人工智能（AI）培訓目的之數據集中；
  • 以任何阻止 Designora | 曜象為其他客戶創作相似作品的方式主張獨佔性著作權（本授權為非獨佔性）。

6. 您上傳的素材

您在平台上傳的任何品牌商標（LOGO）、產品照片、品牌視覺資產或參考材料，版權均完全屬於您。您授予 Designora | 曜象一項有限、臨時且非獨佔的授權，以僅為履行您的訂單及合成設計之目的使用這些材料。未經您的事前同意，我們絕不會將您上傳的資產用於任何其他目的。

7. 不轉讓 AI 底層技術

本授權僅適用於我們交付給您的具體最終設計作品。這並不代表轉讓對我們的 AI 核心模型、算法、生成引擎（包括 Aura Glow 引擎和 Vision 引擎）或任何平台底層技術的權利。

8. 授權何時生效

本條款所述之商業授權及所有權權利，僅在我們收到您對應訂單的全額付款，且將最終確認的設計作品成功交付給您之後，方可正式生效。

Intellectual Property Rights & License for Generated Designs

This section explains the copyright ownership and commercial usage rights for designs generated through our AI-powered design platform.

1. Human Involvement & Copyright Status

Every design delivered by Designora goes through professional human designer review and refinement. Because of this significant human creative input, direction, curation, and quality control, the final approved designs are considered to involve human authorship under UK copyright law.

2. License Granted to You (Commercial Use Rights)

Upon full payment and delivery of the final approved designs, you are granted a:

Perpetual, irrevocable, non-exclusive, royalty-free, worldwide license

to:

  • Use, reproduce, modify, adapt, translate, and create derivative works based on the designs
  • Display, distribute, publicly perform, and commercially exploit the designs
  • Use the designs across any media, channels, and formats (including print, digital, social media, packaging, advertising, websites, and physical products)

This license allows you to freely use the delivered designs for your business, brand, products, and marketing purposes without additional fees or royalties.

3. Ownership of the Delivered Designs

You own the specific final designs we deliver to you for your commercial use. We do not claim copyright ownership over the final approved designs once payment is completed.

4. Our Retained Rights (Portfolio & Showcase)

Designora retains the right to use, display, and showcase the designs (or similar versions) in our portfolio, website, social media, case studies, marketing materials, and promotional content. We may credit your brand name when showcasing the work. If you prefer to remain anonymous, please notify us in writing and we will respect that request where reasonably possible.

5. Restrictions on Your Use

You may not:

  • Resell, redistribute, sublicense, or make the design files available as stock assets, templates, or design resources on platforms such as Shutterstock, Creative Market, Etsy, or similar marketplaces
  • Use the designs to train AI models or include them in datasets for AI training purposes
  • Claim exclusive copyright ownership in a way that prevents Designora from creating similar work for other clients (the license is non-exclusive)

6. Your Uploaded Materials

Any logos, product photos, brand assets, or reference materials you upload remain your property. You grant Designora a limited, temporary, non-exclusive license to use these materials solely for the purpose of fulfilling your order. We will not use your uploaded assets for any other purpose without your consent.

7. No Transfer of AI Technology

This license applies only to the specific final designs delivered to you. It does not transfer any rights to our AI models, algorithms, engines (including Aura Glow Engine and Vision Engine), or underlying technology.

8. When the License Takes Effect

The license and ownership rights described above only become effective after we have received full payment for the order and have delivered the final approved designs to you.
